Terms of use
These terms are the agreement between you and HAYE CO for using ClapOut. We have kept them in plain English; please read them before you play.
1. Accepting these terms
ClapOut, at clapout.app, is made and run by HAYE CO ("we", "us", "our"). By opening a table, joining one, or otherwise using the ClapOut website and game (together, "the service"), you agree to these terms and to our privacy policy. If you do not agree, please do not use the service.
2. The service
ClapOut is a free card game played in a web browser. Anyone can play the full game at no cost, without an account. Some optional extras — packs of Claps and the Club membership — can be bought, as described below.
We are always working on the game, so the service will change over time. We may add, change or remove features, cards, house rules, modes and prices, and we may pause or end parts of the service. The service is provided "as is" and "as available" (see section 12).
3. Who can use ClapOut
- ClapOut is for a general audience. Children under 13 may play only with the supervision of a parent or guardian.
- Signing in and making purchases are for adults. A younger player may do so only with a parent's or guardian's permission, and that parent or guardian is responsible for the purchase.
- If you sign in, you are responsible for keeping access to your sign-in method (your Google or Apple account, or your email) secure, and for what happens under your account.
4. How to behave at a table
ClapOut is meant to be a friendly game. The name you choose and anything you say in voice chat are seen and heard by the other players, so please keep them decent. You must not:
- harass, bully, threaten or abuse other players;
- use hateful, discriminatory or sexual names or speech;
- impersonate another person, another player, or us;
- cheat, or collude with others to get an unfair advantage;
- exploit bugs or errors in the game or its economy, rather than reporting them to us;
- use bots, scripts or any automated means to play, create tables or collect rewards;
- interfere with the service, its servers or other players' games, or try to access anything you are not meant to.
We may remove a player from a table, close a table, reset or remove Claps gained by breaking these rules, or stop someone from using the service, if we reasonably believe these rules have been broken. Within a table, you can also mute any other seat for yourself at any time.
5. Claps
Claps are ClapOut's virtual in-game currency. You receive them free in the game — for example a daily allowance, rewards for challenges and the mini-game, and rewards for choosing to watch a video — and you can also buy packs of them.
- Claps have no cash value. They are a limited licence to use a feature of the game, not money or property you own.
- Claps cannot be redeemed or exchanged for money, goods or anything outside the game.
- Claps cannot be transferred, sold or traded outside the game, and accounts or balances may not be bought or sold.
- We may adjust the economy — for example the amounts of Claps given, the stakes at a table, and the rewards — as the game develops.
- We may correct a balance that is wrong because of an error, a bug, a failed or reversed payment, or abuse.
- If the service ends, any unused Claps may be lost.
Your Claps are kept with the player id in your browser. If you clear your browser's data without having signed in, your Claps may no longer be reachable. Signing in keeps them with your account.
6. Purchases
Purchases are processed by Stripe through Stripe Checkout. The price is shown before you pay, and your receipt comes from Stripe. By buying, you confirm that you are allowed to use the payment method.
Claps packs and the Club are digital content that is delivered to you straight away. Because of that, all sales are final, except where the law gives you a right to a refund, or where we decide to give one at our discretion. Nothing in these terms takes away any right you have under consumer law.
If something goes wrong with a payment — you were charged but did not receive what you bought, you were charged twice, or you do not recognise a charge — please contact us and we will look into it.
7. The Club membership
The Club is an optional recurring subscription.
- It renews automatically at the end of each paid period until you cancel it.
- You can cancel at any time. Cancelling stops the next renewal; it does not refund the current period.
- After you cancel, your Club benefits last until the end of the period you have already paid for.
- We may change the Club's benefits from time to time. The price is always shown before you subscribe.
8. Nothing you buy changes the rules
No purchase — no Claps pack and no Club membership — changes the rules of the game or gives any player an advantage at the table. Every player plays by the same rules, which the table enforces.
9. Ads
ClapOut offers optional rewarded video ads. An ad plays only when you tap to watch one, and you receive the reward it offers once the video has finished, within limits on how often a reward can be claimed. Ads are served by Google; how that works, and your choices about personalised ads, are explained in our privacy policy. We are not responsible for the content of third-party ads or for the products they promote.
10. Intellectual property
ClapOut — its name, its cards and card names, its rules for the elements, its art, its sounds, its text and its code — belongs to HAYE CO or to the people who have licensed their work to us. Some sounds and imagery are used under open licences from others; they are credited on our about page.
We give you a personal, non-exclusive, non-transferable licence to use the service to play the game, for your own non-commercial enjoyment. You may not copy the game, its cards or art; reproduce, sell or distribute it; build a copy or a derivative of it; or reverse engineer it, except where the law expressly allows.
11. Your name and other content
The name you type is shown to the other players at your table. You keep whatever rights you have in it, and you give us a worldwide, royalty-free licence to store, display and transmit it to the extent we need to operate the game. You are responsible for making sure your name does not break section 4 or anyone else's rights. We may change or hide a name that does.
12. Availability and no warranty
We work hard to keep ClapOut running well, but we cannot promise that it will always be available, uninterrupted, secure or free of errors, that a table will never drop, or that a game will never be lost. The service is provided "as is" and "as available", and, to the extent permitted by law, we make no warranties of any kind, whether express or implied, about it.
13. Limitation of liability
To the extent permitted by law, HAYE CO will not be liable for any indirect, incidental, special or consequential loss, for any loss of data, Claps, progress or profit, or for anything caused by events outside our reasonable control. To the extent permitted by law, our total liability to you for any claim about the service is limited to the amount you paid us in the twelve months before the claim.
Nothing in these terms limits any liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud, or your statutory rights as a consumer.
14. Ending your use
You may stop using ClapOut at any time. You can ask us to delete your account by emailing us. We may suspend or end your access to the service if you break these terms, if we must do so by law, or if we stop offering the service. If your access ends, your right to use the service and any Claps ends with it, subject to any refund the law requires.
15. Changes to these terms
We may update these terms from time to time, for example when we add features or when the law changes. We will post the new version on this page with a new effective date. If you keep using ClapOut after a change takes effect, you accept the updated terms.
